The City of Orlando says that, effective July 1, 2026, a new state law (HB803) exempts owners and contractors of single-family dwellings from the requirement to obtain a building permit for work valued at less than $7,500, when exemption eligibility requirements are met. The city says an exemption request must be submitted after confirming all criteria are met, including verifying that the property is not in a flood zone, and that it will review the request within five business days; the page does not name chimney or fireplace work and gives [email protected] as the contact. The city's Applicable Codes for Permitting page says applications submitted after December 30, 2023 are reviewed under codes that include the FBC Residential, FBC Mechanical and FBC Fuel Gas Code, 8th edition (2023), and the Florida Fire Prevention Code, 8th edition.

Its rules allow burning of vegetative debris and untreated wood in a campfire, ceremonial bonfire, outdoor fireplace or other contained outdoor heating or cooking device only when all of conditions a through h are met, including keeping the fire at least 25 feet from any building or combustible structure.
